The law changed in 2025 and INAI was dissolved. Your notice needs to reflect that, and your tool needs to let you evidence consent.

On 20 March 2025 a new Federal Law on Protection of Personal Data Held by Private Parties was published, repealing the 2010 law, and supervision moved from INAI to the Secretaría Anticorrupción y Buen Gobierno. If your privacy notice still names INAI, it is out of date.

Do I need written consent?
For sensitive data — and health status is sensitive — express written consent is required. Keep that document as carefully as the record itself: it is your evidence.
Can I charge in both pesos and dollars?
Yes, though it only pays off with real volume in both markets. At low volume, reconciliation and conversion fees usually outweigh the benefit.
What if I see clients outside Mexico?
More than one framework can apply at once. The prudent path is aligning to the strictest of those that reach you.
