Law 21.719 takes effect on 1 December 2026
Chile moves from one of the region’s oldest data laws to one of its most demanding: a new Data Protection Agency with enforcement powers, full ARCO rights, and a breach notification duty. Law 19.628 governs until then, but the time left to prepare is measured in weeks.

What must be ready before December 2026?
An inventory of the data you process, the basis for each processing documented, updated client-facing information, reviewed vendor contracts, and a written breach procedure.
Does it apply if I work alone with few clients?
Yes. The law reaches anyone processing personal data; size affects which measures are proportionate, not whether it applies.
How long must I keep the clinical record?
Law 20.584 and the Decree 41 regulation set a minimum of fifteen years from the last entry added to the record.
What if the software is hosted outside Chile?
That is an international transfer and must rest on the safeguards the law provides. Ask your vendor for their processing agreement and document where the data sits.
